สำนักงานตำรวจแห่งชาติเตือนนักเดินทาง “การลักลอบขนกัญชา มีความผิดตามกฎหมายไทยและนานาชาติ”
6 กรกฎาคม 2569 พล.ต.ต.จตุรภัทร์ ภิรมย์แก้ว ผู้บังคับการกองการต่างประเทศ ในฐานะรองโฆษกสำนักงานตำรวจแห่งชาติสำนักงานตำรวจแห่งชาติ เปิดเผย 3 คดีเกี่ยวกับการลักลอบส่งออกกัญชาจากไทยไปต่างประเทศ ตามที่ปรากฏเป็นข่าวกรณีศุลกากรฮ่องกงตรวจยึดกัญชาแห้ง ประมาณ 23 กิโลกรัม พร้อมจับกุมผู้ต้องหา 2 ราย เป็นชาวจีน และชาวฮ่องกง ที่เดินทางมาจากประเทศไทย กรณี ปปส.อินโดนีเซีย (BNN) ทลายเครือข่ายลักลอบขนกัญชา และติดตามตัวผู้ต้องสงสัยชาวมาเลเซียและจีน โดยมีการตรวจยึดกัญชาคุณภาพสูงจากไทยได้รวม 3.37 ตัน และกรณีโปแลนด์ยึดกัญชา 1.2 ตัน ถูกซุกซ่อนในอิฐลูกรัง บรรจุในตู้คอนเทนเนอร์ ซึ่งส่งออกมาจากประเทศไทย และจับกุมผู้ต้องหา 8 ราย นั้น
จากกรณีดังกล่าว สำนักงานตำรวจแห่งชาติขอแจ้งเตือนและประชาสัมพันธ์ถึงพี่น้องประชาชน ตลอดจนนักท่องเที่ยวทั้งชาวไทยและชาวต่างชาติ กรณีการพกพา ลักลอบ หรือรับจ้างนำกัญชา ช่อดอกกัญชา หรือผลิตภัณฑ์ที่มีส่วนผสมของกัญชา ออกนอกราชอาณาจักรไทย สำนักงานตำรวจแห่งชาติขอเน้นย้ำว่า การกระทำดังกล่าวถือเป็นความผิดตามกฎหมาย แม้กัญชาจะมีการปลดล็อกในบางส่วนสำหรับการใช้ทางการแพทย์ภายในประเทศไทย แต่การนำออกนอกประเทศยังคงถูกควบคุมอย่างเข้มงวด และเป็นสิ่งผิดกฎหมายร้ายแรงในหลายประเทศปลายทาง ดังนั้น เพื่อให้มีความรู้ความเข้าใจที่ถูกต้อง สำนักงานตำรวจแห่งชาติขอชี้แจงข้อกฎหมายที่เกี่ยวข้อง ดังนี้
1. ความผิดตาม พ.ร.บ.ศุลกากร พ.ศ. 2560 ซึ่งมีอัตราโทษสูงสุดคือ จำคุกไม่เกิน 10 ปี หรือปรับเป็นเงิน 4 เท่าของราคาของ (รวมค่าอากรแล้ว) หรือทั้งจำทั้งปรับ
2. ความผิดตาม พ.ร.บ.คุ้มครองและส่งเสริมภูมิปัญญาการแพทย์แผนไทย พ.ศ. 2542 ซึ่งมีอัตราโทษสูงสุดคือ จำคุกไม่เกิน 1 ปี หรือปรับไม่เกิน 20,000 บาท หรือทั้งจำทั้งปรับ
3. ความผิดตามประกาศกระทรวงสาธารณสุข เรื่อง สมุนไพรควบคุม (กัญชา) พ.ศ. 2568 ซึ่งมีอัตราโทษจำคุกไม่เกิน 1 ปี หรือปรับไม่เกิน 20,000 บาท หรือทั้งจำทั้งปรับ
4. กฎหมายของประเทศปลายทาง (สากล): กัญชายังคงถูกจัดเป็นยาเสพติดให้โทษประเภทที่ 1 ในหลายประเทศทั่วโลกและประเทศเพื่อนบ้าน การลักลอบนำเข้ามีโทษตามกฎหมายของประเทศนั้นๆ ซึ่งมีตั้งแต่การจำคุกตลอดชีวิต ไปจนถึงโทษประหารชีวิต
สำนักงานตำรวจแห่งชาติมีความห่วงใยในสวัสดิภาพของประชาชน จึงขอเตือนสติ และแนะนำวิธีการป้องกันตนเอง เพื่อไม่ให้เข้าไปมีส่วนเกี่ยวข้องกับขบวนการลักลอบขนกัญชาข้ามชาติ
1. ห้ามรับฝากสิ่งของจากผู้อื่น: ห้ามรับฝากกระเป๋าเดินทางหรือสิ่งของจากบุคคลแปลกหน้า หรือแม้แต่คนรู้จัก เพื่อนำเดินทางออกนอกประเทศโดยเด็ดขาด หากตรวจพบสิ่งผิดกฎหมาย จะต้องรับโทษในฐานะผู้ครอบครองและลักลอบทำผิดกฎหมาย
2. ตรวจสอบสัมภาระอย่างละเอียด: ตรวจสอบกระเป๋าเดินทางของตนเองให้แน่ใจว่าไม่มีผลิตภัณฑ์ที่มีส่วนผสมของกัญชา (เช่น ยาดม, ชา, ขนม, หรือเครื่องสำอางบางชนิด) ปะปนอยู่ก่อนเดินทางไปต่างประเทศ
3. ห้ามรับส่งสิ่งของข้ามประเทศโดยเด็ดขาด: ห้ามประชาชนรับงานเป็น ”คนหิ้ว” เพื่อขนส่งสิ่งของหรือสัมภาระใดๆ ไปยังต่างประเทศโดยเด็ดขาด เพื่อความปลอดภัยของประชาชน เนื่องจากไม่สามารถทราบแน่ชัดได้ว่ามีสิ่งใดซุกซ่อนอยู่ภายในสัมภาระ หรือใครคือผู้อยู่เบื้องหลังการขนส่งดังกล่าว ขบวนการอาชญากรรมข้ามชาติอาจพุ่งเป้า หลอกใช้ ข่มขู่ หรือแม้กระทั่งทำร้ายประชาชน เพื่อปกป้องเครือข่ายการกระทำความผิดของตน
ความร่วมมือจากภาคประชาชนคือกลไกสำคัญในการป้องกันและปราบปรามอาชญากรรม หากพบเห็นพฤติกรรมต้องสงสัย ข้อผิดปกติ หรือบุคคลที่มีพฤติการณ์ลักลอบนำกัญชาออกนอกประเทศ หรือมีการชักชวนจ้างวานผ่านช่องทางออนไลน์ สามารถแจ้งเบาะแสทางสายด่วน 191 และ 1599 ได้ตลอด 24 ชั่วโมง
สำนักงานตำรวจแห่งชาติพร้อมดำเนินการตรวจสอบทุกเบาะแสอย่างจริงจัง และเก็บข้อมูลของผู้แจ้งไว้เป็นความลับสูงสุด เพื่อกวาดล้างขบวนการลักลอบนำสิ่งผิดกฎหมายออกนอกประเทศ

The Royal Thai Police Issues Travel Alert: Cannabis Export is an offense to Thai and international law.

(July 6, 2026) – Pol. Maj. Gen.Jaturapat Bhiromkaew, Deputy Spokesperson of the Royal Thai Police (RTP) has revealed details regarding three recently reported cases concerning the illicit export of cannabis from Thailand to international destinations. These include an incident where Hong Kong Customs seized approximately 23 kilograms of dried cannabis (cannabis buds) and arrested two suspects, a Chinese national and a Hong Kong resident, who had traveled from Thailand; a case in which the National Narcotics Agency of Indonesia (BNN) dismantled a smuggling network and is pursuing Malaysian and Chinese suspects following the seizure of 3.37 tons of high-quality cannabis originating from Thailand; and a third case where Polish authorities intercepted 1.2 tons of cannabis concealed inside laterite bricks within shipping containers exported from Thailand, resulting in the arrest of eight suspects.

In this regard, Pol. Maj. Gen.Jaturapat Bhiromkaew, Deputy Spokesperson of the RTP, emphasised an official warning and public advisory to all citizens and international tourists regarding the carrying, smuggling, or being hired to transport ”cannabis,” cannabis buds, or cannabis-infused products out of the Kingdom of Thailand. The RTP clearly stated that such actions are illegal. Although cannabis has been partially decriminalized for medical purposes within Thailand, taking it out of the country remains strictly controlled and is considered a serious criminal offense in many destination countries.

The RTP clarifies the relevant legal provisions as follows:
1. Violations of the Customs Law (Customs Act, B.E. 2560 (2017)) with a maximum penalty of imprisonment for a term not exceeding 10 years, a fine equal to 4 times the price of the goods (including duty), or both.
2. Offense under the Protection and Promotion of Traditional Thai Medicine and Herbal Wisdom (Act, B.E. 2542 (1999)) with a maximum penalty of imprisonment for a term not exceeding 1 year, a fine not exceeding 20,000 baht, or both
3. Offenses under the Ministry of Public Health Notification regarding Controlled Herb (Cannabis) (Act, B.E. 2568 (2025)) with a term of imprisonment not exceeding 1 year, a fine not exceeding 20,000 baht, or both.
4. Destination Country Laws (International) as cannabis is still classified as a Category 1 illicit narcotic in many countries, including neighboring countries. Smuggling it into these countries carries severe legal consequences, ranging from life imprisonment to the death penalty.

Out of concern for public wellbeing, the RTP urges everyone to remain vigilant and recommends the following preventive measures to avoid any involvement in transnational cannabis smuggling syndicates:
1. Do Not Accept Luggage from Others: Strictly refuse to carry bags, luggage, or packages for strangers—or even acquaintances—when traveling abroad. If illegal items are found, you will be held entirely liable for possession and smuggling.
2. Inspect Your Luggage Thoroughly: Before traveling overseas, double-check your belongings to ensure no cannabis-infused products (such as certain herbal inhalers, teas, snacks, or cosmetics) are accidentally mixed into your luggage.
3. Strictly Prohibited to Act as a Courier (Mule): It is strictly forbidden to accept jobs as a ”mule” or to transport goods and luggage overseas on behalf of others under any circumstances. Furthermore, for your own safety, you can never be certain what is inside the luggage or who is behind the shipment. Transnational criminal syndicates may target, exploit, intimidate, or even harm you to protect their operations.
